Union Wins $70,000 in Owed Longevity for Pest Control Workers

WILLIAMS Local 768 won a collective $70,000 in owed longevity payments for 35 City Pest Control Aides and Exterminators at the Dept. of Health and Mental Hygiene after forcing the agency to apply the contract’s recurring increment payments, or RIPs. “The union remains diligent in protecting members’ hard won wages and benefits, whether it means fighting over federal rollbacks on union rights or correcting the mistakes made by agency management,” said Local 768 President Fitz Reid. “If it impacts our members, we are here to make sure the contract and the members are respected.” Several CPCAs and Exterminators called the union after DOHMH failed to apply or took away the contractual RIPs they were entitled to. Union Wins on New Full-Time Positions at H+H Facility

BY DIANE S. WILLIAMS In an ongoing fight to protect jobs and benefits, the union settled a group grievance to convert nine per diem, hourly and part-time workers at the Susan B. McKinney long-term care facility in Brooklyn to permanent, full-time positions. “These members were hired as part timers but management assigned extra hours and full time work schedules from day one without full time benefits or the opportunity to become full time NYC Health+Hospital employees,” said Local 420 President Carmen Charles, who represents the eight Patient Care Technicians and one Housekeeper the union filed the group claim for. “To add insult to injury,” Charles said, “McKinney management would hire new people off the street as full-time employees, without considering these workers who were already on staff.” “Many of the workers felt they were overlooked because the nursing director [More...]

Grievance Victories for Local 768 Members at NYC H+H

WILLIAMS The union settled three separate grievances in favor of Local 768 members employed at New York City Health +Hospitals facilities, in an ongoing fight to protect unionized hospital workers from managers who would violate the contract. Kings County Hospital failed to pay Social Worker Level 2 Adam Turkel for the overtime hours he was assigned to work so Hospitals and Healthcare Professionals Division Council Rep Joel Viera-Vera filed a grievance for the Local 768 member. The case went to Step 2 when H+H finally agreed to compensate Mr. Turkel for two hours of overtime. “These members are relied on to make up for staff shortages,” said Local 768 President Fitz Reid. “So while it may seem small, on principle we stood up for Mr. Turkel and in doing so protected the right of every member to be fairly compensation for any overtime hours worked.” Woodhull Hospital [More...]

Metropolitan Museum of Art Workers Win Health-Care Dispute

By GREGORY N. HEIRES Thirty-four guards at the Metropolitan Museum of Art will have extra cash on hand for the holidays thanks to the resolution of a payroll dispute between the union and management. Each guard is due $1,200 as the museum acknowledged its failure to meet its obligation to compensate workers who declined to sign up for health-care coverage because they enrolled in an outside plan. Earlier this year, Metropolitan Museum of Art Local 1503 President Rawle Campbell started to investigate the problem after three members — Maria Mantzavinou, Lara Pink and Vera Quehaja — brought the matter to his attention. They had noticed their paychecks didn’t list the payments for the health-care waiver. Pink said the personnel department told her the payments weren’t made because the federal government adopted a new policy requiring recipients to request the opt-out every year. [More...]

Hospital Worker Wins $2,550 in Retro Pay

By DIANE WILLIAMS Serious illness almost cost Harlem Hospital Patient Care Associate Daniel Brewington his job. With help from his union, the Local 420 member is back at work — and receiving approximately $2,550 in retroactive longevity pay that a management snafu had denied him. After 22 years on the job, Brewington left Harlem Hospital on a medical leave that extended beyond one year. In accordance with NYC Health+Hospitals policy, the length of leave triggered termination of his employment. Brewington recovered and the hospital reinstated him in September 2015, after DC 37 attorneys brought his case before the NYC H+H Personnel Review Board (PERB). “The outcome of that hearing was favorable for Mr. Brewington and he got his job back, but NYC H+H managers failed to restore his longevity pay for years of service,” said union Council Rep Joel Viera Vera. Member at Harlem Hospital Wins Title Upgrade and Back Pay

WILLIAMS A Local 420 member at Harlem Hospital won a $7,400 title upgrade and $3,200 in back pay after the Office of Labor Relations favorably decided a grievance the union filed on her behalf. Shirley Medina worked for Harlem Hospital as a Central Supply Assistant since 2002. By November 2015, she met the state requirements for certification as a Central Service Technician, Level 2, which pays about $7,400 more annually. The following year, in 2016, the union and Health and Hospitals revised the Central Supply Assistant title to Central Service Technician, levels 1 and 2. “I took the exam, met the hour requirements and submitted my paperwork so I thought I’d automatically get the bump up.
